NLRB Suspends New Election Rules

In response to the court decision that was the subject of an Alert yesterday, the National Labor Relations Board ("NLRB") has suspended the "quickie election" rules that had been implemented on April 30. The NLRB took that action to study and consider the court decision. Nevertheless, NLRB Chairman Mark Gaston Pearce commented that the NLRB believes the new rules represented a "significant improvement in our process" and said the agency was "determined to move forward." In light of these comments, it will not be surprising if the NLRB arranges to have a meeting with a quorum present and votes again to adopt the "quickie election" rules.
